Welcome to Lowcountry Littlewear (“Lowcountry Littlewear,” “we,” “us,” or “our”). We operate this website and store, including all related information, content, features, tools, products, and services (collectively, the “Services”). Our store is hosted on Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”), together with any policies referenced here (including our Privacy Policy), describe your rights and responsibilities when you use the Services. By visiting, interacting with, or purchasing from our store, you agree to be bound by these Terms and our Privacy Policy found at Privacy policy – Lowcountry Littlewear. If you do not agree, do not use the Services.

1. ACCESS & ACCOUNT

You represent that you are at least the age of majority in your state or province of residence, and you consent to any minor dependents using the Services on devices you own or manage. You may be asked to provide information (e.g., email, billing, payment, and shipping details). You warrant such information is accurate and you have the right to provide it. You’re responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not transfer or sell your account.

2. OUR PRODUCTS

We strive to display products accurately; however, colors and appearance may vary due to device settings. We do not warrant that any product will meet your expectations. Product descriptions, prices, and availability may change at any time without notice. We may discontinue products and limit quantities per person, household, or order.

3. ORDERS

Your order is an offer to purchase. We may accept or reject any order at our discretion. Orders are accepted only once payment is processed and you receive an order confirmation. Please review your order carefully; cancellation requests may not be possible after acceptance. If we cancel or change an order, we’ll attempt to notify you using the contact details you provided. Returns and exchanges are governed solely by our Refund Policy at Refund policy – Lowcountry Littlewear. You represent that purchases are for personal or household use and not for resale or export.

4. PRICES & BILLING

Prices, discounts, and promotions may change without notice. The price charged is the price in effect at the time of order and will be listed on your confirmation. Unless stated otherwise, prices exclude taxes, shipping, duties, and import fees. You agree to provide current, complete payment information and authorize us (and our payment processors) to charge all amounts due, including applicable taxes and shipping.

5. SHIPPING & DELIVERY

Delivery dates are estimates and not guarantees. We aren’t liable for delays caused by carriers, customs, or events beyond our control. Title and risk of loss pass to you upon our transfer to the carrier.

6. INTELLECTUAL PROPERTY

All content and materials in the Services (including text, graphics, logos, images, videos, and designs) are owned by Lowcountry Littlewear or our licensors and are protected by applicable laws. You may use the Services for personal, non-commercial purposes only. No rights are granted by implication or otherwise except as expressly stated. Lowcountry Littlewear names, logos, and related marks are our trademarks. Shopify’s marks are trademarks of Shopify Inc. All other marks are the property of their respective owners.

7. OPTIONAL TOOLS & NEW FEATURES

We may provide access to third-party tools we don’t monitor or control. You use them “as is” and at your own risk. Future features and resources are also subject to these Terms.

8. THIRD-PARTY LINKS

The Services may link to third-party websites or content. We don’t endorse or control such sites and aren’t responsible for their content, policies, or practices. Review third-party terms and policies before engaging in any transaction.

9. RELATIONSHIP WITH SHOPIFY

Lowcountry Littlewear is powered by Shopify, but your purchases are with Lowcountry Littlewear, not Shopify. Shopify is not responsible for sales between you and us. You expressly release Shopify and its affiliates from claims arising out of your transactions with Lowcountry Littlewear.

10. PRIVACY

Personal information collected through the Services is governed by our Privacy Policy at Privacy policy – Lowcountry Littlewear. Because our store is hosted by Shopify, Shopify also processes certain information as described in Shopify’s privacy documentation. By using the Services, you consent to such processing and to cross-border transfers as necessary to provide the Services.

If you submit ideas, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and display the Feedback for any purpose. To the fullest extent permitted by law, Lowcountry Littlewear and our officers, employees, agents, contractors, service providers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, revenue, savings, data, or replacement costs) arising from your use of the Services or products, even if advised of the possibility. Our aggregate liability for direct damages shall not exceed the amount you paid to us for the product(s) giving rise to the claim.

17. INDEMNIFICATION

You agree to indemnify and hold harmless Lowcountry Littlewear and our affiliates, officers, directors, employees, and agents from claims and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, violation of law, or misuse of the Services.

If any provision is unlawful or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

19. WAIVER & ENTIRE AGREEMENT

Our failure to enforce any right isn’t a waiver. These Terms, together with policies posted on the site (including the Privacy Policy and Refund Policy), constitute the entire agreement between you and us and supersede prior agreements.

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer our rights and obligations without notice.

21. GOVERNING LAW & VENUE

These Terms and any disputes will be governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. You consent to exclusive jurisdiction and venue in the state and federal courts located in Charleston County, South Carolina.

Headings are for convenience only and do not affect interpretation.

You can review the current version of the Terms at any time on this page. We may update these Terms by posting a new version with a new “Last updated” date. Your continued use of the Services after changes are posted constitutes acceptance.
